What Is Kratom

Kratom (scientific name Mitragyna speciosa) is a tropical tree native to Southeast Asia and a cousin to the coffee family. Is Kratom Legal in California

Yes, kratom is legal in most of California, but not everywhere.
You can buy, possess, and use kratom in its natural form, throughout the state except within the city limits of San Diego and Oceanside, both of which have legally restricted kratom locally.
These bans only apply within the city boundaries. So if you’re anywhere else in California, all kratom products available on Mount Kratom are fully legal.

That said, the legal landscape is changing, not for natural kratom, but for synthetic and concentrated kratom products that artificially increase the potency of 7-hydroxymitragynine.

In August 2025, the Orange County Board of Supervisors joined several Southern California cities in banning synthetic kratom products. These bans specifically concentrated or synthetic versions of kratom containing elevated levels of 7-hydroxymitragynine (7-OH), often found in gas stations and smoke shops under flashy names.

Latest Local Bans in California (August 2025)

Here’s the current breakdown as of late 2025:

Banned:

San Diego – All forms of kratom is prohibited within city limits since 2016.
Oceanside – All forms of kratom have been banned shortly after San Diego’s ordinance.
Newport Beach – Recently enacted a ban on synthetic kratom only.
Orange County (unincorporated areas) – In August 2025, passed a ban on synthetic kratom products only.

Natural kratom remains unregulated at the state level, and fully legal everywhere else in the state.
